Gli utenti, come persone, soggiacciono esclusivamente alle norme civili e penali che limitano dall’esterno la libertà di opinione. Tali regole si configurano come veri e propri limiti alla libertà di espressione del pensiero, connessi anche alle peculiarità del rapporto di lavoro: si tratta di esplicitazioni dei doveri di fedeltà e di riservatezza, che incombono sul lavoratore poiché deducibili nella prestazione lavorativa.
Moderazione

In fact, Nardi – Personal S.p.A. cannot be held liable for verbal continence, substantial continuity of the facts and the social relevance of the declarations made by the users.

Nardi – Personal S.p.A. recalls that the so-called Social Network platforms, based on art. 21 of our Constitution “…. everyone has the right to freely express his/her thoughts by word, writing and any other means of diffusion ….”, are among the means of diffusion through which it is possible to express one’s opinions, judgments and criticism. Users, as individuals, are subject only to civil and criminal laws that limit freedom of opinion from the outside. These rules are configured as real limits on the freedom of expression of thought, also connected to the peculiarities of the employment relationship: these are explanations of the duties of loyalty and confidentiality, which are incumbent on the worker since they are verifiable in the work performance.
Moderation
Everyone has the right to intervene and express his/her free opinion. In the social channels promoted by Nardi – Personal S.p.A. can remove comments and posts that are not relevant to the topic of the channel, but not only: it can remove messages and posts deemed harmful, discriminatory and offensive towards the same or other users participating or not in the discussion.
The various pages / channels of Nardi – Personal S.p.A. present on the various Social Media, can be freely followed by all users of the network, without asking for any authorization from the Owner/Data Controller; for this reason, Nardi – Personal S.p.A., advises to exercise caution regarding the dissemination of personal (and sensitive) data when using these platforms. The terms of use and the privacy policies applicable to each social network are published on their respective sites and regulate the information provided by the user. The Owner/Data Controller does not exercise any form of control over the use of personal information communicated in a public forum, a comment area, making the user of the platform the only responsible party for any disclosure.
Insults, foul language, threats or attitudes that harm the personal dignity, the rights of minorities and minors, the principles of freedom and equality will not be tolerated. The following things will also be moderated: comments that are off topic compared to the discussion of a certain post (the so-called off-topic); comments or posts that may refer to sensitive data or a context that limits users’ freedoms; interventions entered repeatedly or which may disturb the discussion or offend those who manage and moderate social channels, spam. For those who repeatedly violate these conditions or the ones contained in the policies of the tools adopted, the staff reserves the right to block the user to prevent further interventions and to report the same, to the managers of the platform and possibly to law enforcement authorities.
PRIVACY AND PERSONAL DATA PROCESSING
Nardi – Personal S.p.A. recalls that the processing of users’ personal data on the so-called platforms Social Media is guaranteed to the extent that the user is aware of how he is using the platform, the service and its potential. It follows that the information generated will actually be shared “voluntarily” by users who, therefore, will not be able to complain of a possible violation of their personal sphere. Furthermore, personal data are published spontaneously by users and their processing by Nardi – Personal S.p.A. is carried out solely for the purpose of the service provided.

B – Dati oggetto del trattamento
Per “trattamento di dati personali” deve intendersi qualsiasi operazione o insieme di operazioni, compiute con o senza l’ausilio di processi automatizzati e applicate a dati personali o insiemi di dati personali, come la raccolta, la registrazione, l’organizzazione, la strutturazione, la conservazione, l’adattamento o la modifica, l’estrazione, la consultazione, l’uso, la comunicazione mediante trasmissione, diffusione o qualsiasi altra forma di messa a disposizione, il raffronto o l’interconnessione, la limitazione, la cancellazione o la distruzione. Nello specifico si tratta di dati da Lei conferiti volontariamente per l’esecuzione dei rapporti giuridici in essere con il Titolare del trattamento dei dati personali.
L’art. 4 del Regolamento UE 2016/679 definisce “dato personale” qualsiasi informazione riguardante una persona fisica identificata o identificabile («interessato»); si considera identificabile la persona fisica che può essere identificata, direttamente o indirettamente, con particolare riferimento a un identificativo come il nome, un numero di identificazione, dati relativi all’ubicazione, un identificativo online o a uno o più elementi caratteristici della sua identità fisica, fisiologica, genetica, psichica, economica, culturale o sociale.
I dati oggetto di trattamento, di seguito sinteticamente elencati, in forma del tutto esemplificativa ma di certo non esaustiva, saranno da Lei conferiti volontariamente per l’esecuzione dei rapporti giuridici in essere e/o futuri:
A ciò si aggiungono i dati di navigazione, i sistemi informatici e le procedure software preposte al funzionamento di questo sito web, che potrebbero acquisire, nel corso del loro normale esercizio, i suoi dati personali, la cui trasmissione è implicita nell’uso dei protocolli di comunicazione di Internet. I dati personali da Lei conferiti saranno trattati per le seguenti finalità:
D – Base giuridica del trattamento
In riferimento alle finalità di cui ai punti da 1 a 6 del paragrafo C, il trattamento è necessario all’esecuzione di un rapporto giuridico di cui Lei è, così come potrà essere, parte o all’esecuzione di misure precontrattuali adottate su Sua richiesta. Il trattamento è, pertanto, lecito (art. 6, co. 1, lett. b), Regolamento UE 2016/679). In riferimento alle finalità di cui al punto 7 del paragrafo, il trattamento è facoltativo e pertanto soggetto a Suo consenso per essere lecito (art. 6 co. 1 lett. a).
E – Durata del trattamento
I dati personali raccolti per le finalità di cui ai punti da 1 a 6 del paragrafo C, saranno trattati per un arco di tempo non superiore al conseguimento delle finalità per le quali sono trattati e per i successivi dieci (10) anni per esigenze di legge. I dati relativi alla finalità di cui al punto 7 saranno trattati per due (2) anni, dalla data di loro acquisizione, salvo eventuale richiesta da parte dell’interessato. Tali dati, allo scadere di detto termine, saranno distrutti.
I dati personali contenuti in documenti rilevanti per fini amministrativo-contabili saranno in ogni caso conservati nel rispetto degli obblighi di legge.
F – Natura del conferimento dei dati
Il conferimento dei dati è obbligatorio in relazione alle finalità da 1 a 6 del paragrafo C, ossia per adempiere agli obblighi di natura giuridica riguardo ad un rapporto giuridico instaurato e per ogni altra finalità connessa a obblighi di legge, regolamenti e normative comunitarie; il rifiuto alla comunicazione dei dati impedirà al Titolare di adempiere tali obblighi e di conseguenza l’impossibilità di fornirLe i servizi e/o le prestazioni da Lei richieste. Il conferimento dei Suoi dati ed il consenso al trattamento per le finalità di cui al punto 7 sono del tutto facoltativi. Il mancato conferimento al trattamento ovvero il consenso, al trattamento dei Suoi dati personali per la finalità sopra indicata comporterà l’impossibilità di svolgere attività di promozione in ambito marketing e di comunicazione commerciale via e-mail, oppure via telefono, in merito ai servizi prestati dal Titolare, anche per il tramite di partner.
G – Modalità di trattamento dei dati
I dati saranno trattati e archiviati esclusivamente per le finalità sopra indicate mediante l’utilizzo di supporti sia cartacei che informatici, inseriti in pertinenti banche dati e trattati con strumenti idonei a garantire l’integrità, la sicurezza e la riservatezza dei dati stessi, in conformità con quanto stabilito dal Regolamento UE 2016/679. (hereafter, “Company”, “Organization” or “Data Controller “), with registered office in Corso Venezia, 61 – 20121 MILANO and Operational Headquaters in Via Vittorio Veneto, n. 85 – 21049 Tradate – Abbiate Guazzone (VA), e-mail: privacy@nardi-personal.com, informs you herewith that the data provided by you in relation to existing and/or future legal relationships (user/data subject) will be processed in compliance with the aforementioned legislation.
The aforementioned processing will take place in a lawful way and according to the principles of art. 5 of the EU Regulation 2016/679. Further communications may be disclosed later either written or verbal.
The updated list of external data processor officers and persons authorized to process the data is kept by the Company in its archives, at the Operational Headquarters of the Company.
B- Data subject to processing
“Personal data processing” means any operation or set of operations performed with or without the aid of automated processes and applied to personal data or sets of personal data, such as collection, recording, organization, structuring , storage, adaptation or modification, extraction, consultation, use, disclosure by transmission, dissemination or any other form of making available, comparison or interconnection, limitation, deletion or destruction. Specifically, these are data voluntarily provided by you for the execution of the legal relationships in place with the Data Controller.
Article 4, paragraph 1, of EU Regulation 2016/679 defines “personal data” as any information concerning an identified or identifiable natural person (“data subject”); it is considered identifiable the natural person who can be identified, directly or indirectly, with particular reference to an identifier such as the name, an identification number, location data, an online identifier or one or more characteristic elements of his physical , physiological, genetic, psychic, economic, cultural or social identity.
The data subject to processing, summarized below, in a completely exemplary but certainly not exhaustive form, will be voluntarily provided by you for the execution of existing and/or future legal relationships:
Added to this are the navigation data, the IT systems and the software procedures used to operate this website, which could acquire during their normal operation your personal data, and the transmission of which is implicit in the use of the Internet communication protocols. E – Duration of the data processing
The personal data collected for the purposes referred to in points 1 to 6 of paragraph C, will be processed for a period of time not exceeding the achievement of the purposes for which they are processed and for the subsequent ten (10) years for legal requirements . The data relating to the purposes referred to in point 7 will be processed for two (2) years, from the date of their acquisition, unless requested by the interested party. Such data, upon expiry of said term, will be destroyed.
The personal data contained in documents relevant for administrative-accounting purposes will in any case be kept in compliance with legal obligations.
F – Nature of the provision of data
The provision of data is mandatory in relation to the purposes from 1 to 6 of paragraph C, i.e., to fulfill the legal obligations regarding an established legal relationship and for any other purpose connected to legal obligations, regulations and community legislation; the refusal to communicate the data will prevent the Data Controller from fulfilling these obligations and consequently the inability to provide you with information and/or services requested by you. The provision of your data and consent to the processing for the purposes referred to in point 7 are completely optional. Failure to provide the conferment or rather the consent to the processing of your personal data for the aforementioned purpose will make it impossible to perform promotional activities within marketing and commercial communication by e-mail or telephone regarding the services provided by the Data Controller including also through any partners.
G – Data processing methods
The data will be processed and stored exclusively for the purposes indicated above through the use of both paper and computer media, inserted in relevant databases and processed with suitable tools to guarantee the integrity, security and confidentiality of the data, in accordance with the provisions of the EU Regulation 2016/679. All the appropriate technical and organizational measures will be taken to ensure a level of data protection compliant with the provisions of the EU Regulation 2016/679. Access will be allowed only to persons authorized in writing to process personal data. The data may also be communicated and/or collected for/by third parties (as in the case of data acquisition from processing centers or from other companies). What are cookies?
Pursuant to Recital 30 of the said GDPR “Natural persons can be associated with online identifiers produced by the devices, applications, tools and protocols used, such as IP addresses, temporary markers (cookies) or other identifiers, such as radio frequency identification tags. These identifiers can leave traces which, in particular if combined with unique identifiers and other information received from the servers, can be used to create profiles of natural persons and identify them”.
Cookies are small text files sent to the users’ devices. These files are stored to be resent to the same sites of origin on the occasion, for example, of a subsequent visit (so-called user tracking). The Cookies can be stored within the user’s device directly from the website that the latter is visiting (first-party site) or from a different website, so-called “third party”, as in every website there may be elements (i.e., images, maps, sounds, specific links to web pages of other domains, etc.) that may reside and/or lead the user to other servers which may differ from those provided by the first-party site. Through the storage of cookies, the user can customize the use of some website contents by saving their preferences. In this manner, several preferences may be associated to the user and then classify them (profiling). For example, it is possible to set up a cookie for the recognition of the user registered on the site a new authentication on the occasion of a new visit (login).
Furthermore, Cookies are pseudonymous data, i.e., personal data where the identification elements have been replaced by other elements (such as text strings and numbers): by crossing them with other information, it is possible to identify the person, or to identify the device used to access and to browse.
Taxonomy proposed by the Guarantor
Through the Provision n. 229 of May 8, 2014 and the Guidelines on the use of cookies and other tracking tools of June 10th, 2021, the Authority proposes a taxonomy that identifies two categories of cookies based on two possible processing purposes:
Technical cookies
They are cookies that are used to browse and/or provide a service to the user. They are not used for other purposes and are installed directly by the website owner. Without these cookies, some operations could not be performed or would be more complex and/or less secure, such as home-banking activities (display of the bank statement, wire transfers, payment of bills, etc.), for which cookies are indispensable, as they make and they keep the user’s identification during the session.
Profiling cookies
These cookies are used to track the user’s online browsing and to create profiles on preferences, habits, choices, etc. With these cookies, advertising messages can be transmitted to the user’s device in line with the preferences expressed by the same user when browsing online.
User’s consent for the installation of cookies on the device
The expression of consent to the storage of cookies depends on the purposes for which the cookies themselves are used, and on these it depends whether they fall in the cases of “technical cookies” or “profiling cookies”. For the installation of technical cookies, no consent is required from the users while, in the case of third-party cookies, it is necessary, among other things, to provide appropriate information (pursuant to art. 12 of the EU Regulation 2016/679). However, with regard to profiling cookies only, they can be installed on the user’s device only if the same has expressed his/her free, voluntary, specific and unequivocal consent after having been adequately informed.
About the user’s consent on cookies
Whether giving or not the consent on the cookie storage, it depends on if they are technical cookies or profiling cookies. No consent is needed for the installation of technical cookies, whereas with regard to third-party cookies an information pursuant to Article 12 of the GDPR is necessary.
Profiling cookies are installed on the user’s device after expressing a freely given, specific, informed and unambiguous consent.
Furthermore, with regard to the new Guidelines the obligation to obtain consent as appropriate with a view to the use of cookies and other tracking tools is set out. That means that, by default, no cookies or tools other than technical ones are placed on the user’s device when that user first accesses a website, and that no other active (i.e. third party cookies) or passive (i.e. fingerprinting) tracking technique is used at that time.
With regard to profiling cookies, to give their consent to the storing of cookies or the use of other tracking techniques, that user should therefore simply close the banner by clicking on the command that is usually meant to enable this action – i.e., the ‘X’ that is normally positioned according to well-received practice at the top right end of the banner area – without having to access other ad-hoc areas or pages.

The Authority has specified that analytical cookies belong with the category of technical cookies and may accordingly be used without the data subject’s prior consent providing certain conditions are met, in particular:

Cosa sono i cookie
Il Considerando 30 del Regolamento europeo in materia di protezione dei dati personali (GDPR), stabilisce che “Le persone fisiche possono essere associate a identificativi online prodotti dai dispositivi, dalle applicazioni, dagli strumenti e dai protocolli utilizzati, quali gli indirizzi IP, marcatori temporanei (cookies) o identificativi di altro tipo, quali i tag di identificazione a radiofrequenza. Tali identificativi possono lasciare tracce che, in particolare se combinate con identificativi univoci e altre informazioni ricevute dai server, possono essere utilizzate per creare profili delle persone fisiche e identificarle”.
I cookie sono file di testo che i siti visitati dagli utenti inviano ai dispositivi di questi ultimi. Detti file vengono memorizzati al loro interno per essere poi ritrasmessi, in un secondo momento, agli stessi siti di origine in occasione di una visita successiva (c.d. tracciamento degli utenti). I cookie possono essere depositati all’interno del dispositivo dell’utente direttamente dal sito web che quest’ultimo sta visitando (sito di prima parte) oppure da un sito web diverso (sito di terza parte), poiché all’interno di ogni sito web possono essere presenti elementi (immagini, mappe, suoni, specifici link a pagine web di altri domini, ecc.) che possono risiedere e/o portare l’utente a link presenti su server differenti da quelli che erogano il sito di prima parte. Grazie all’archiviazione dei cookie l’utente può personalizzare la fruizione di alcuni contenuti del sito web mediante salvataggio di proprie impostazioni preferite. Tassonomia proposta dal Garante
Nel Provvedimento n. 229 dell’8 maggio 2014 e nelle Linee Guida del 10 giugno 2021, il Garante per la protezione dei dati personali propone una tassonomia che identifica due categorie di cookie in base a due possibili finalità di trattamento:
Cookie Tecnici
Servono a effettuare la navigazione e/o a fornire un servizio all’utente. Non vengono utilizzati per scopi ulteriori e sono normalmente installati direttamente dal Titolare del sito web. Senza il ricorso a tali cookie, alcune operazioni non potrebbero essere compiute o sarebbero più complesse e meno sicure, come ad esempio le attività di home-banking (visualizzazione dell’estratto conto, bonifici, pagamento di bollette, ecc.), per le quali i cookie, che consentono di effettuare e mantenere l’identificazione dell’utente nell’ambito della sessione, risultano indispensabili. Per tali motivi, tali cookie non richiedono l’acquisizione del consenso.
Cookie di profilazione
Sono utilizzati per tracciare la navigazione dell’utente in rete e creare profili su gusti, abitudini, scelte, ecc. Con questi cookie possono essere trasmessi al dispositivo utente messaggi pubblicitari in linea con le preferenze già manifestate dallo stesso utente nella navigazione online.
Consenso dell’utente per l’installazione dei cookie sul dispositivo
L’espressione del consenso all’archiviazione dei cookie dipende dalle finalità per le quali i cookie stessi vengono usati e da queste dipende se essi ricadono nei casi di “cookie tecnici” o di “cookie di profilazione”. Per l’installazione di cookie tecnici non è richiesto nessun consenso agli utenti mentre, nel caso di cookie di terze parti è necessario, tra l’altro, fornire un’idonea informativa (ex art. 12 Regolamento Ue 2016/679). In merito, invece, ai soli cookie di profilazione, gli stessi possono essere installati sul dispositivo dell’utente soltanto se lo stesso ha espresso il proprio libero, volontario, specifico ed inequivocabile consenso dopo essere stato adeguatamente informato.
Peraltro, con le nuove Linee Guida si è stabilito che il meccanismo di acquisizione del consenso on line deve innanzitutto garantire che, per impostazione predefinita, al momento del primo accesso ad un sito web, nessun cookie o altro strumento diverso da quelli tecnici venga posizionato all’interno del dispositivo dell’utente, né venga utilizzata altra tecnica di tracciamento attiva (ad esempio, cookie di terze parti) o passiva (ad esempio, il fingerprinting).
Per i cookie di profilazione vi è la necessità del consenso da richiedere attraverso un banner distinguibile sulla pagina web, attraverso il quale viene offerta agli utenti la possibilità di proseguire la navigazione senza essere in alcun modo tracciati, ad esempio chiudendo il banner cliccando sulla caratteristica X da inserire in alto a destra.
